New York DWI Overview

In New York, DWI and DUI mean the same thing – drunk driving….whether you’re in upstate or in the NYC metro area.

And if you’ve been arrested and charged with DWI in New York…. you have legal issues that will require smart and professional legal representation.

New York DWI Penalties

New York law states that drivers that are stopped and arrested – the first time – can:

  • Lose their drivers license for as long as six months;
  • Have to pay up to $1,000 in fines;
  • Spend up to one year in jail, and;
  • Be required to participate in a Drinking Driver Program (DDP), and;
  • Have to install and maintain an ignition interlock on any vehicle owned and operated by such driver for at least 6 months.

Those are serious issues.  Even worse though, if you’re found guilty of DWI, you’ll end up with a criminal record – which many times will cost you your job.

The only worse penalties are handed out to those that have a prior DWI conviction in the past 10 years. These arrests fall under New York Felony DWI DUI Penalties.

Other issues that can have a major impact on whether you’re convicted for DUI in New York, is whether breath, blood, or urine testing was done after the arrest – and were the results over the legal limit?  If they were, that’s were an experienced NY DWI attorney can make all the difference in the world.

We’ve put together much more detailed information about New York DWI testing and specific legal defenses we utilize in court at our New York DWI Testing and legal defense pages.  Why not take a minute or two and get your questions answered about blood tests, urine tests and breath tests.

Driving Privileges…. The Most Important Issue For Many Of Our Clients

Over the years, there’s one thing we’ve learned – for most of our clients, being able to drive as soon as possible after an arrest for DWI in New York is extremely important.

In this state, there’s no way around the law – when you are arrested and charged with DWI, and you refused to take a chemical test to determine your Blood Alcohol Content (BAC)….your license is suspended right there at your arraignment.

Your drivers license can then be revoked for at least one year after a hearing by the Department of Motor Vehicles.

Again, for this type of situation, it really is on your best interest to get the very best DUI attorney you can find.
